1. Introduction

1.1 These Terms and Conditions govern your participation in the Be.EV Charging Trial (the “Trial”) provided by Motability Operations Ltd (“Motability Operations”, “we”, “us” or “our”).

1.2 By enrolling in or participating in the Trial, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you must not participate in the Trial.

1.3 These Terms and Conditions apply in addition to your existing Motability Scheme agreement and any separate terms that apply to your use of the Be.EV charging network.

2. Eligibility

2.1 To participate in the Trial, you must:

• be a current Motability Scheme customer;
• be aged 18 or over;
• have received a direct invitation from Motability Operations to participate; and
• successfully enrol in the Trial in accordance with the instructions provided.

1. 1. The Trial is personal to the named recipient and applies only to charging the Motability Scheme vehicle supplied for that recipient’s use.
   2. The Trial may be used by the named recipient, their authorised appointee, or any named driver on the Motability Scheme agreement, solely for the purpose of charging the recipient’s Scheme vehicle. The Trial must not be used to charge any other vehicle.
   3. Places in the Trial are limited and participation is subject to availability
   4. We reserve the right to verify your eligibility and to withdraw access to the Trial if you are found not to meet the eligibility criteria.

3. Trial Period and Pricing

3.1 The Trial will run for a period of six (6) months from the Trial start date (the “Trial Period”).

3.2 During the Trial Period, you will receive a 42% discount on the standard pay-as-yougo (PAYG) price set by Be.EV at the time of charging for energy consumed at participating Be.EV public charging locations.

3.3 The applicable PAYG price is set by Be.EV and may vary by location, time, and other factors. The discounted price will be calculated at the point of charging.

3.4 If you charge your vehicle using any other public charging network or operator during the Trial Period, you will be charged the applicable pricing set by that operator at the time of charging. Motability Operations is not responsible for pricing set by other operators.

3.5 Standard parking restrictions or site-specific conditions imposed by landowners or local authorities may still apply at certain locations and remain your responsibility.

4. No Additional Charges

4.1 You will not be charged any additional subscription, membership, or participation fee by Motability Operations for taking part in this Trial.

4.2 Charges for electricity consumed under this Trial will be payable in accordance with the payment method linked to your Go with Motability App charging access.

5. Early Termination and Changes 

5.1 Motability Operations reserves the right to amend, suspend or terminate the Trial at any time and for any reason, including before the end of the Trial Period.

5.2 We will exercise this right reasonably and where possible, we will provide notice if the Trial is ended early.

5.3 If the Trial ends or your participation is withdrawn, standard Be.EV network pricing will apply to any future charging sessions through the Go With Motability App.

6. Acceptable Use

6.1 You agree to use the Trial for lawful, personal use only.

6.2 You must not attempt to misuse, manipulate, resell, share or otherwise exploit access to the Trial or the 42% discount as set out in Clause 3 above..

6.3 We reserve the right to withdraw your participation if we reasonably believe you have breached these Terms and Conditions.

7. Confidentiality and Public Communications 

7.1 As this is a limited trial, we ask that you do not share detailed information about your participation (including specific pricing, access arrangements, or how the Trial operates) in public forums or on social media. This helps us manage the Trial fairly and ensures it operates as intended for all participants.

8. Data Protection

8.1 Motability Operations will not share your personal data with Be.EV for the purposes of this Trial.

8.2 Motability Operations may use information relating to your participation in the Trial (such as charging activity and usage patterns) to monitor and evaluate the performance of the Trial. Any such information shared with Be.EV will be anonymised and/or aggregated, and will not identify you.

9. Liability 

9.1 Motability Operations is not responsible for the operation, availability, performance or maintenance of Be.EV charging infrastructure.

9.2 To the extent permitted by law, Motability Operations shall not be liable for any indirect or consequential loss arising from participation in the Trial.

9.3 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

10. General

10.1 We may update these Terms and Conditions from time to time. The latest version will apply to your participation in the Trial.

10.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.3 These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
